The legal issues stemming from the deadly shooting on the movie set of Rust, involving Alec Baldwin, are far from resolved.
Although Alec Baldwin won’t face criminal charges, he’s now involved in a civil lawsuit. A jury will determine if his behavior on the day of the shooting was careless enough to be considered negligence.
Civil Trial Set for October
A judge in Los Angeles decided that Alec Baldwin will go to civil court over the 2021 shooting on a movie set that resulted in the death of cinematographer Halyna Hutchins.
This decision allows Serge Svetnoy, a member of the film crew, to proceed with his lawsuit. Svetnoy claims the shooting caused him significant emotional trauma. Although he wasn’t physically hurt, he says he was near enough to the gunshot to feel and hear it.
The court case, previously scheduled for May, has been delayed until October 12, 2026. This is because both the plaintiff and defendant are still collecting evidence and discussing a potential out-of-court agreement.
Criminal Case May Be Over—But Legal Questions Remain
This lawsuit follows the dismissal of the criminal manslaughter charge against Baldwin earlier in 2024. The criminal case was dropped because prosecutors didn’t share important evidence with the defense.
Civil court works differently, though. Instead of deciding if Alec Baldwin committed a crime, the issue is whether his actions with the gun were careless or showed a lack of responsibility.

And according to Judge Maurice Leiter, that question is far from settled.
According to the prosecutor, a jury could conclude that Mr. Baldwin acted carelessly by pointing a loaded gun at someone and pulling the trigger, potentially causing them emotional harm.
This statement shows the court thinks there’s enough evidence for a jury to carefully consider what Baldwin did.

Baldwin has consistently argued:
- He was told the gun was safe
- He had no knowledge of a live round
- He did not intentionally pull the trigger

The court’s decision means lawsuits can continue against Rust Movie Productions, despite arguments that the matter should be limited to workers’ compensation claims.
